ELIGIBILITY: This Sweepstakes is open to legal residents of the U.S. and its territories, possessions and commonwealths (excluding Puerto Rico) who are 18 years of age or older as of January 1, 2010 and own a home. Employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of where they reside) are not eligible to participate. By entering, all participants and/or entrants release Pitcher Perfect from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or his/her receipt or use of the prize awarded in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer’s terms. This Sweepstakes is governed by the U.S. law and is subject to all federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and where prohibited by law.
GRAND PRIZE DRAWING: One $10,000.00 Grand Prize Winner will be selected by Scott Pitcher in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about November 20, 2010. The odds of winning the Grand Prize depend upon the number of eligible entries received for the entire
Sweepstakes Period. Winners will be notified on the Website, and by phone, mail and/or email at Pitcher Perfect’s discretion.
Weekly $100.00 Prize Drawing: Each Friday from 3/1/10 until 11/19/10, Pitcher Perfect will draw one winner randomly from the entries submitted that week. The weekly winner will receive a $100.00 cash prize, and will automatically be entered into the $10,000.00 Grand Prize Sweepstakes. The weekly prize winner will be notified and shall have until the following Thursday at 5:00 P.M. to pick up their $100.00 prize at any Pitcher Perfect office. You must re-submit your entry each week to be eligible to win.
PRIZE/APPROXIMATE RETAIL VALUES (ARV)/ODDS: One (1) Grand Prize - $10,000 worth of residential repairs or remodeling performed by Pitcher Perfect. Pitcher Perfect will refund the Grand Prize winner the total cost of their Pitcher Perfect contracts up to $10,000.00. For example, if the Grand Prize Winner entered into a contract with Pitcher Perfect for $7,500.00 in siding and windows, Pitcher Perfect would refund the winner $7,500.00, no additional money would be due to the winner. If the Grand Prize Winner had not previously purchase a Pitcher Perfect installed product, then that Grand Prize Winner would be entitled to received $10,000.00 worth of goods and services from Pitcher Perfect for a residential remodeling project. If the Grand Prize Winner is to have Pitcher Perfect install products then Pitcher Perfect and the Grand Prize Winner shall enter into a contract on or before December 31, 2010 and all work shall be completed on or before April 30, 2011. Prize will be awarded to the winner at Pitcher Perfect’s main office in East Peoria by Pitcher Perfect. Odds of winning depend on the total number of eligible entries received. Unclaimed prizes will not be awarded. All applicable federal, state, and local taxes on prize are the sole responsibility of the prize winner.
GRAND PRIZE WINNER NOTIFICATION: Pitcher Perfect anticipates that the potential Grand Prize Winner will be contacted in person on or about November 20, 2010, (subject to change) in the form of an “ambush style” visit by Pitcher Perfect representatives and such potential Grand Prize Winner may be filmed during such visit by Pitcher Perfect. Pitcher Perfect also reserves the right to randomly select an unspecified number of potential finalists for the Grand Prize and require them to travel at Pitcher Perfect’s expense to a location in the United States where the Grand Prize Winner will be selected in a random drawing that may be televised. Potential Grand Prize Winner will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted by law), and return same, fully executed, within five (5) days of date of issuance of prize notification. Pitcher Perfect may require the potential Grand Prize Winner to travel at Pitcher Perfect’s expense to the Pitcher Perfect Siding & Window Company, Inc., 898 S. Main Street, East Peoria, Illinois, for publicity purposes. If Pitcher Perfect is unable to contact the potential Grand Prize Winner within five (5) days of date of the initial attempt, if the potential Grand Prize Winner fails to return all requested forms fully-executed by the specified date, or if the potential Grand Prize Winner fails to comply with these Official Rules, including travel on the dates and times required by Pitcher Perfect, his/her place as a Grand Prize Winner will be forfeited at Pitcher Perfect’s discretion and an alternate Grand Prize Winner may be selected, at Pitcher Perfect’s sole discretion. Pitcher Perfect reserves the right to notify the potential Grand Prize Winner by overnight courier and/or telephone. Pitcher Perfect and Sweepstakes Administrator’s decisions with respect to the Grand Prize Winner and other matters pertaining to the Sweepstakes shall be final and binding and are subject to change. By entering into the Sweepstakes, each entrant consents to the use by Sweepstakes Entities and their designees of his/her name, photograph, likeness, biography, and voice.
GENERAL: All costs, taxes, fees and expenses associated with the prize or the acceptance and use of any element of the prize not specifically addressed above are the sole responsibility of the winner. All federal, state and local taxes on prize are winner’s responsibility. Grand Prize Winner will be issued a 1099 tax form for the assessed retail value of the prize. Prize cannot be transferred, substituted or redeemed for cash except at Pitcher Perfect’s sole discretion. Pitcher Perfect reserves the right to substitute the prize, or portion(s) thereof, with a prize of comparable or greater value, at its sole discretion. By participating, entrants and winner release and agree to hold harmless, Pitcher Perfect, their respective parent companies, retailers affiliates, directors, employees, officers and agents, including without limitation, their advertising/promotional agencies from any and all liability, injury, loss or damage of any kind, arising from or in connection with participation in the Sweepstakes, or the awarding, receipt, possession, use or misuse of any prize and/or with respect to participation in any prize related activity. Winners acknowledge that neither Pitcher Perfect nor its agents have made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to, its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturers’ terms therefore and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Sponsor is not responsible for any typographical or other error in printing, offering or announcement of prize. By participating in this promotion, entrants agree to be bound by the Official rules and the decisions of the judges, which are final and binding in all respects.
INTERNET: Pitcher Perfect is not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Pitcher Perfect or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Pitcher Perfect which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserved the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspect the Sweepstakes and award the prize via random drawing from among the eligible entries received up to the action taken by Pitcher Perfect.
